INTRODUCTION

The Company adheres to and complies with “Know your customer” principles, which aim to prevent financial crime and money laundering through client identification and due diligence, in accordance with UK federal and provincial anti-money laundering legislation including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA).

The casino Kong reserves the right, at any time, to ask for any KYC documentation it deems necessary to determine the identity and location of a user at Kongcasino.ca (here and after – the Website). We reserve the right to restrict the service, payment, or withdrawal until identity is sufficiently determined, or for any other reason in our sole discretion based on the UK legal framework and FINTRAC (Financial Transactions and Reports Analysis Centre of the UK) requirements.

We take a risk-based approach and perform strict due diligence checks and ongoing monitoring of all clients, customers, and transactions in compliance with the UK anti-money laundering regulations. As per the money laundering regulations, we utilize three stages of due diligence checks, depending on the risk, transaction, and customer type.

  • SDD — simplified due diligence is used in instances of extremely low-risk transactions that do not meet the required thresholds under the UK regulations
  • CDD — customer due diligence is the standard for due diligence checks, used in most cases for verification and identification in accordance with FINTRAC guidelines
  • EDD — enhanced due diligence is used for high-risk customers, large transactions or special cases as required by the UK AML legislation.

DOCUMENTS

Below you can find different types of documents and information that can be requested from your side (Documents) depending on the screening type indicated above and in compliance with identification requirements:

The minimum identification data set includes:

  • full name;
  • date of birth;
  • permanent residence address in the UK;
  • identification number (Social Insurance Number, driver’s license number, or other government-issued ID number);

The actual identification documents are:

  • actual UK passport/provincial ID card/driver’s license;
  • document confirming the client’s permanent residence address in the UK at the given time (utility bill, bank account statement, government correspondence, etc.) not older than 6 months.

Additional identification documents are:

  • additional UK national identity card (driver’s license, health card, etc.);
  • photos of a user with an open passport/ID against the background of his face (readable);
  • bank card front photo (5 first and 4 last digits, owner’s name, and expiry date, readable) – must be from a UK financial institution.

The documents provided might not be approved for the following reasons:

  • address/name on documents do not match with account name/address;
  • illegible documents or copies;
  • damaged documents;
  • documents not confirming the user’s age, name, or other required information;
  • unreadable documents;
  • not acceptable documents (for example, a user sends a copy of a document that is not on the accepted documents for ID verification or a copy of mail envelope instead of an actual utility bill);
  • documents not issued by the UK authorities or financial institutions;
  • any other reasons employees or contractors of the Company shall deem appropriate under the UK regulatory requirements.

Once Documents are uploaded, the user will get a “Temporarily Approved” Status and the documents will now be on our side. The “KYC Team” will have 24 hours to go over them and email the user about the outcome: (1) Approved; (2) Rejected; (3) More information needed (with no further change in Status);

Users with “Temporarily Approved” Status can normally use the platform but their right to complete any withdrawals is limited in accordance with gaming regulations.

Upon the results of the Documents analysis, the Company makes a final decision in compliance with the UK AML requirements. When the KYC process is unsuccessful then the reason is documented and a support ticket is created in the system. The ticket number along with an explanation is communicated back to the user.

In the event, the user fails to pass a KYC check successfully, then he cannot make additional deposits or withdrawals of any amount, as required by anti-money laundering legislation.

If a user has passed the KYC process successfully then prior to any withdrawal, there is a detailed algorithmic and manual check on the activity and balance of the user to see if the amount withdrawn is a result of proper activity in the platform, in accordance with FINTRAC reporting requirements.

Privacy Notice: All personal information collected during the KYC process will be handled in accordance with privacy laws including PIPEDA and applicable provincial privacy legislation. Your information may be reported to FINTRAC as required by the UK law.

Under no circumstances may a user transfer funds directly to another user, as this violates the UK anti-money laundering regulations.
